HB1219 by Haggerty (Relating to the location and operation of concrete crushing facilities.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to exempt portable facilities from public notice requirements where facilities would be relocated to sites where a portable facility had been located at any time during the previous two years.  The bill would establish specific criteria under which concrete crushing facilities would be allowed to operate in certain areas and have an exemption from public notice requirements.  The bill would also require the Texas Commission on Environmental Quality to adopt rules necessary to implement the provisions of the bill before January 1, 2004.

 

The Texas Commission on Environmental Quality indicates it could absorb costs associated with the bill within its current resources. 

 

The Texas Department of Transportation estimates a savings of $600,000 each year for construction related costs for transporting crushed concrete; however, it is assumed that any savings realized from the implementation of the bill would be used for other eligible transportation related expenditures. 

 

The bill would take effect immediately upon receiving a two-thirds majority vote in both houses; otherwise, the bill would take effect September 1, 2003.

No significant fiscal implication to units of local government is anticipated.
