No fiscal implication to the State is anticipated.

The bill would impose time limits for requesting a special education due process hearing and filing an appeal of a special education hearing officer’s decision.  Under the bill, a person must request a special education due process hearing within one year of discovery of the action that is the basis for the request.  In addition, the bill would require that an appeal of a hearing officer’s decision be filed within 90 days of the date of the written decision.
