The bill would amend the Health and Safety Code by changing exceptions to permitting requirements for the location of certain portable concrete crushing facilities. The bill would amend the current requirement for the Texas Commission on Environmental Quality to prohibit, by rule, the location and operation of a concrete crushing operation which is located within 440 yards of a building used as a single or multifamily residence, school, or place of worship to include exceptions regarding the requirements of the bill that would not apply to facilities in counties of 2.4 million or more or in a county adjacent to such a county.
Based on the analysis of the Department of Transportation and the Commission on Environmental Quality, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources and that no significant fiscal implication to the state is anticipated due to the number of rock crushers that could be affected.
