No significant fiscal implication to the State is anticipated.


The bill would amend provisions in the Water Code relating to contested case hearings for Concentrated Animal Feeding Operations (CAFO), resulting in rulemaking and operational changes for the Commission on Environmental Quality (TCEQ) which are not anticipated to result in significant fiscal implications to the agency.


Local Government Impact

Local governments protesting a CAFO permit application that is renewed or amended could be required to pay the legal fees of the permit holder. The TCEQ estimates that attorney fees could range between $5,000 to $100,000.
