LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

April 11, 2003

TO:
Honorable Joe Driver, Chair, House Committee on Law Enforcement

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB1368 by McReynolds (Relating to the prosecution and punishment of the offense of making a false report to a peace officer or law enforcement employee.), Committee Report 1st House, As Amended

No significant fiscal implication to the State is anticipated.

The bill would amend the Penal Code by making the offense of false report to a peace officer or a law enforcement employee punishable as a Class A misdemeanor if certain conditions are met.  The offense of false report to a peace officer or a law enforcement employee is currently punishable as a Class B misdemeanor.  It is assumed that implementation of the bill would not have a significant impact on the costs of state government.

Local Government Impact

No significant fiscal implication to units of local government is anticipated. The enhancement of the punishment of the offense of false report to a peace officer or a law enforcement employee from a Class B misdemeanor to a Class A misdemeanor could mean additional jail time for offenders but could also mean additional fine revenues.
