FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

April 7, 2003

TO:
Honorable Terry Keel, Chair, House Committee on Criminal Jurisprudence

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB1412 by Christian (Relating to procedures for establishing a public appointment list of attorneys from which to appoint counsel for indigent defendants.), As Introduced

No fiscal implication to the State is anticipated.

The bill amends Article 26.04(d) of the Code of Criminal Procedures relating to procedures for establishing a public appointment list of attorneys from which to appoint counsel for indigent defendants.  The bill removes the requirement for an attorney to apply to be included in the public appointment list of attorneys used by county courts, statutory county courts, and district courts trying criminal cases in each county.  The Act takes effect September 1, 2003.

Local Government Impact

No significant fiscal implication to units of local government is anticipated. Local governmental entities would incur minimal costs researching names of lawyers to add to the public appointment list.
