LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

April 7, 2003

TO:
Honorable Terry Keel, Chair, House Committee on Criminal Jurisprudence

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB1424 by Keel (Relating to requiring superintendents and general managers of institutions to report the deaths of certain individuals; providing a criminal penalty.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would require institutions to notify The Office of the Attorney General of an individual’s death within 24 hours of the death and further requires that a report must be submitted within 72 hours of their death. The reports will be available to the public unless a portion of the report is exempt from public disclosure or privileged from discovery. It further states the Office of Attorney General may investigate any Institution that receives payments through the medical assistance program.  The Texas Department of Criminal Justice and the Office of the Attorney General anticipate no significant fiscal impact from this bill.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.  Local governmental entities would incur costs to meet the reporting deadline to the Office of the Attorney General, but these costs are not expected to be significant.
