LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

May 8, 2003

TO:
Honorable Steve Ogden, Chair, Senate Committee on Infrastructure Development and Security

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB1439 by Eissler (Relating to the application and enforcement of traffic regulations in private subdivisions in certain counties.), As Engrossed

No fiscal implication to the State is anticipated.

By changing the population requirements, the bill would allow more counties than are currently permitted to do so, to extend traffic regulations to private roads if petitioned by at least 25 percent of the property owners having property along the roads or requested by the entity that currently provides maintenance of the roads. The county could charge a fee to the property owners to cover all or part of the expenses for regulating traffic. The county could also place traffic control devices on property abutting private roads under certain circumstances.

It is assumed that counties that are petitioned to provide traffic regulations on private roads would charge fees that are sufficient to cover the costs of providing the service.

The bill would take effect September 1, 2003.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
