LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

April 8, 2003

TO:
Honorable Joe Nixon, Chair, House Committee on Civil Practices

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB1699 by Kuempel (Relating to the liability of highway, road and street contractors.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would relieve a highway contractor of liability for torts arising from construction or repair if the contractor was in substantial compliance with specifications. The contractor may be liable if the contractor was not in substantial compliance with all specifications for the construction or repair, and that failure was the proximate cause of the personal injury, property damage or death to a third party.

The Department of Transportation indicates the bill would not have a cost to the state.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
