No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure, Chapter 2 to require state prosecutors in capital cases to indicate in writing the mandatory and discretionary criteria used to decide whether to seek the death penalty. The bill would require state prosecutor offices to post the criteria in county courthouses of each county within the jurisidiction of the office.

Local Government Impact

No significant fiscal implication to units of local government is anticipated. Each office would incur minimal costs to prepare and post their criteria in each capital case.
