No fiscal implication to the State is anticipated.
The bill would limit the location where certain treatment facilities may be constructed or operated. The governing body of the municipality in which a facility is proposed would be required to hold a hearing to determine if the facility would be within the boundary limit of 1,000 feet from an affected property and must issue a resolution of consent before the facility may be established at the proposed location. The bill would take effect September 1, 2003 and would apply only to construction or operation of a treatment facility that begins on or after December 1, 2003.
