No fiscal implication to the State is anticipated.

The bill would amend the Government Code to narrow the specific uses of the records management and preservation fee collected by a district clerk. The bill would take effect September 1, 2003 and would apply only to a fee that becomes payable under the provisions of the bill on or after that date.

Current law allows for a records management and preservation fee to be collected by a district clerk. The fee is collected at the time a suit, petition or any number of legal actions are filed. The bill specifically notes that fees collected under Section 51.317 of the Government Code would be available for records management and preservation only, which would include records automation. The bill would not change the amount of fees being collected or the circumstances under which the fees are collected; therefore, there would be no fiscal impact on the state or units of local government.
