No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to authorize a county commissioners court to regulate development in the unincorporated areas of the county, except for tracts of land that the appraisal district appraises as agricultural or open-space land under Subchapters C or D, Chapter 23 of the Tax Code. The commissioners court would be allowed to set reasonable fees related to implementation and enforcement of regulations. The commissioners court would be allowed to adopt orders to enforce regulations and violators could be fined in district court from $500 to $1,000 per violation per day the violation continues to occur.

The bill would take effect September 1, 2003.


Local Government Impact

Because fees would offset costs, no significant fiscal implication to units of local government is anticipated.
