LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

March 30, 2003

TO:
Honorable Dennis Bonnen, Chair, House Committee on Environmental Regulation

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB2052 by Smith, Wayne (Relating to restrictions on the location of an industrial solid waste landfill.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would prohibit the Texas Commission on Environmental Quality (TCEQ) from issuing a permit for an industrial solid waste landfill if the proposed site is: three miles or less from a coastal bay system, and is in a county with a population of 35,000 or less that is adjacent to a county with a population of two million or more; and the county commissioners court adopts an order recommending denial of the application.

Local Government Impact

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House as to its probable fiscal implication on units of local government.
