LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

May 18, 2003

TO:
Honorable Jane Nelson, Chair, Senate Committee on Health & Human Services

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB2099 by Dutton (Relating to the determination of the conservatorship of, and the right of possession of or access to, a child by a person who has a history of family violence.), As Engrossed

No fiscal implication to the State is anticipated.

In proceedings related to the appointment of a conservator for a child, the bill would require a court to consider whether a protective order was rendered against the parent during the previous two years in determining if that parent has a history or pattern of certain violent or neglectful behavior. The Department of Protective and Regulatory Services indicates that passage of the bill would not have a fiscal impact to the state.

Local Government Impact

No fiscal implication to units of local government is anticipated.
