LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

May 22, 2003

TO:
Honorable Tom Craddick, Speaker of the House, House of Representatives

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB2116 by Brown, Fred (Relating to the operation of Texas Task Force 1.), As Passed 2nd House

No significant fiscal implication to the State is anticipated.

The would direct the Governor's Division of Emergency Management to reimburse the State Office of Risk Management for the full costs associated with any medical and indemnity benefits incurred by members of Texas Task Force 1 while under formal deployment of the Governor or under normal training evolutions.   The bill would obligate the Governor's Division of Emergency Management to assume the compensatory benefit costs sustained by any employee defined in this legislation.  The Texas Engineering Extension Service would be obligated to provide the personnel data required to process any such claims.

Due to the lack of historical experience in worker's compensation related claims during State deployments, it is not possible to quantify specifically the potential costs of this obligation to the Governor's Division of Emergency Management.

Local Government Impact

Some savings for local government units are anticipated.  However, due to the lack of historical experience during State deployments, either at the formal direction of the Governor's Division of Emergency Management, or under regularly scheduled training evolutions, it is not possible to estimate the amount of savings to local governments.
