No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to add to the regulations that are exempt from requirements applicable to local permits regulations to prevent the imminent destruction of property or injury to persons if the regulations do not affect lot size, lot dimensions, lot coverage, building size, residential or commercial density, or the timing of a project or change development permitted by a restrictive covenant required by the municipality.

The bill would also clarify language regarding certain regulations that are exempt that apply to preventing imminent destruction of property or injury to persons from flooding.

The bill would take effect immediately if it receives a two-thirds vote in each house; otherwise, it would take effect September 1, 2003.
