No significant fiscal implication to the State is anticipated.
The bill amends Section 396 of the Finance Code and would transfer the powers and duties relating to the regulation of private child support enforcement agencies from the Texas Department of Banking to the Office of the Attorney General (OAG).The OAG estimated approximately $7,500 per fiscal year in appropriated receipts would result from the registration of Private Child Support Enforcement Agencies (PCSEA) at $500 per private agency.The OAG stated they would be required to administer detailed application and registration procedures, accept annual fees, review and certify financial documents, deposit surety bonds, investigate written complaints against PCSEAs, oversee an administrative hearing process and revoke registration if necessary.The Act takes effect September 1, 2003.
