HB2345 by Mowery (Relating to requiring a municipality to make a change in zoning. ), Committee Report 1st House, Substituted

No fiscal implication to the State is anticipated.

The bill would allow a landowner of undeveloped land, within one year of the initial zoning, to petition the municipality for a change in zoning. The zoning commission would be required to hold a hearing to consider the petition. Provisions of the bill would establish criteria to be considered in determining if rezoning is required. The bill would take effect immediately if it receives a two-thirds vote in each house; otherwise, it would take effect September 1, 2003.

The fiscal impact of holding a hearing would be insignificant. If zoning changes are made, the impact would depend on what the zoning is changed from and to, although it is expected to have an insignificant fiscal impact.


Local Government Impact

No significant fiscal implication to units of local government is anticipated.
