LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

April 8, 2003

TO:
Honorable Robert Talton, Chair, House Committee on Urban Affairs

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB2345 by Mowery (Relating to requiring a municipality to make a change in zoning.), As Introduced

No fiscal implication to the State is anticipated.

The bill would require a municipal zoning commission, when petitioned by a landowner of undeveloped property in the municipality, to hold a hearing to determine whether a change in zoning of the property is required. The bill would take effect immediately if it receives a two-thirds vote in each house; otherwise, it would take effect September 1, 2003.

The fiscal impact of holding a hearing would be insignificant. If zoning changes are made, the impact would depend on what the zoning is changed from and to, although it is expected to have an insignificant fiscal impact.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
