The bill would amend the Transportation Code to require the Texas Transportation Commission (TTC) to designate a highway as part of the state highway system upon determining it to be necessary for the proper development and operation of the system. The bill would also allow the TTC to remove a segment of the state highway system upon determining the segment is not needed for the system. The bill would authorize the TTC to recommend the transfer of property to the governor and to transfer property without recommending the transfer to the governor under specific circumstances and conditions. The bill would establish guidelines and restrictions for transferring or selling highway right-of-way and would allow the Texas Department of Transportation to transfer ownership of historic bridges to local government entities, or private parties, under certain conditions.
Based on the analysis of the Texas Department of Transportation, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
