LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

May 13, 2003

TO:
Honorable Robert Duncan, Chair, Senate Committee on Jurisprudence

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB2402 by Stick (Relating to the compensation of district judges in Collin and Travis counties.), Committee Report 2nd House, Substituted

No fiscal implication to the State is anticipated.

The bill would amend Government Code, Sections 32.043(a) and 32.227(a) to remove the salary cap for district judges in Collin County and Travis County respectively. The bill would also repeal Government Code, Sections 32.043(d) and 32.227(c), which requires the salary of a district court judge in Collin County or in Travis County that is received from state and county sources to be at least $1,000 lower than the salary received from state and county sources by a justice of the court of appeals in the district in which Collin County or Travis County is located. The bill would allow the Collin County or Travis County commissioner's court to give salary increases to district judges at each county's discretion.  The bill would take effect September 1, 2003.

Local Government Impact

Because the bill provides for county commissioners of Collin County or Travis County to budget for judicial salaries in amounts at each county's discretion, the fiscal implication of any savings or costs each county may realize under the bill is not anticipated to be significant.
