LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

April 9, 2003

TO:
Honorable Fred Hill, Chair, House Committee on Local Government Ways and Means

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB2404 by Turner (Relating to penalties to defray a taxing unit's costs of collecting delinquent property taxes.), As Introduced

No fiscal implication to the State is anticipated.

The bill would permit taxing units or appraisal districts to apply all or part of a 20 percent collection penalty on delinquent taxes to payment of attorney's fees.  Since these penalties do not impact taxable property values reported to the Commissioner of Education by the Comptroller, no fiscal impact to the state is anticipated.

Local Government Impact

Local taxing units that negotiate delinquent property tax collection contracts allowing them a portion of the 20 percent additional penalty would receive additional revenue not available under current law.
