No significant fiscal implication to the State is anticipated.


The bill would amend the Health & Safety Code to require facilities that provide personal care services to three or fewer people unrelated to the owner to register with the Department of Human Services (DHS) and pay a registration fee. DHS may deny, suspend or revoke registration if the facility violates Chapter 247 or a rule adopted under the chapter. A facility that fails to register is subject to the penalties in Subchapter C. The registration is valid for a two-year period. Facilities would not need to register with DHS until March 1, 2004. The bill would require the Department of Protective and Regulatory Services (PRS) to conduct investigations of abuse, neglect and exploitation at facilities registered under this section.

 

DHS indicated that the cost pursuant to implementation of the bill would be $18,831 in General Revenue and 0.4 FTEs for fiscal years 2004 through 2008. DHS estimated that the possible gain to the General Revenue Fund to be $8,800 in fiscal year 2004, $10,200 in fiscal year 2005, increasing to $12,010 in fiscal year 2008.

 

PRS indicated that any costs associated with implementation of the provisions of the bill could be absorbed within existing resources.
