No fiscal implication to the State is anticipated.


The bill would amend Health and Safety Code, Chapter 247, section 247.030 that authorizes the Department of Human Services (DHS) to license Type E assisted living facilities. According to the DHS, Type E facilities are currently licensed in accordance with Chapter 21, 1988 edition of the National Fire Protection Association (NFPA) 101. DHS indicated that the amendment section 247.030 references conformance of Type A and Type B facilities with the 1988 edition of NFPA, Chapter 21. DHS stated that large Type B facilities are not licensed in conformance with Chapter 21, NFPA; they are licensed under Chapter 12. Section 247.030 only references requirements for Type E facilities.
