No significant fiscal implication to the State is anticipated.

The bill relates to the creation of a foundation to finance health programs in the border counties of the state. The bill would require the Office of Border Health within the Department of Health (TDH) to establish the Border Foundation as a nonprofit corporation. The bill would require the Office of Border Health to ensure that the Border Foundation operates independently of any state agency or political subdivision. Under the bill's provisions, the executive committee of the Office of Border Health would be required to appoint five members to the board of directors of the foundation and to fill vacancies as the occur. Not later that the 60th day after the last day of the fiscal year, the Border Foundation would be required to report to the Office of Border Health all income and expenditures and to describe all activities of the foundation during the preceding fiscal year.

TDH indicates that existing resources could be used to establish the Border Foundation and to oversee the Foundation's Board of Directors. According to the Comptroller of Public Accounts, the bill would have no effect on current state revenue and would have no fiscal impact on the state.
