LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

May 29, 2003

TO:
Honorable Tom Craddick, Speaker of the House, House of Representatives

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB2500 by Harper-Brown (Relating to the enforcement of fares imposed for the use of certain public transportation systems; providing penalties. ), As Passed 2nd House

No fiscal implication to the State is anticipated.

The bill would authorize certain public transportation systems to prohibit from using the system a person who fails to possess evidence showing that the appropriate fare for the use of the system has been paid. The board of the transportation system would be authorized to impose a penalty not to exceed $100 for nonpayment for use of the system. The transportation authority would be required to post signs regarding areas such persons are prohibited from using.

A person would commit a Class C misdemeanor if they were to use a public transportation system without showing evidence that the fare has been paid or if they fail to pay. A district court would be authorized to expunge court records and files relating to an arrest for the offense.

The bill would take effect immediately if it receives a two-thirds vote in each house; otherwise, it would take effect September 1, 2003.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
