LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

April 11, 2003

TO:
Honorable Dennis Bonnen, Chair, House Committee on Environmental Regulation

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB2554 by Smith, Wayne (Relating to the application of new requirements for commercial nonhazardous industrial solid waste landfill facilities to be adopted by the Texas Commission on Environmental Quality.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill provides that as soon as practicable after the effective date of the bill, the Commission on Environmental Quality (TCEQ) shall adopt rules governing all aspects of the management and operation of new commercial landfill facilities that propose to accept nonhazardous industrial solid waste. It would require the TCEQ to suspend processing of an application for a disposal permit for such a facility until the rules are adopted, and that the rules be applicable to every new nonhazardous industrial solid waste application, whether filed after the effective date of the bill or pending on the effective date.

It is expected that rulemaking and development of operating procedures required to implement the provisions of the bill could be accomplished within current agency resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
