LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

May 21, 2003

TO:
Honorable Troy Fraser, Chair, Senate Committee on Business & Commerce

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB2579 by Goolsby (Relating to the extended hours of sale for mixed beverages and beer in certain counties.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Alcoholic Beverage Code to address the extended hours a retailer that sells mixed beverages and beer may operate depending on the population of the city or county in which the retailer operates. The bill would take effect September 1, 2003.

Allowing retailers in cities to operate extended hours would increase the potential for sales tax collected. The amounts would vary depending on the number of retailers to which the bill would apply and the number that would choose to operate extended hours. The increase is not expected to be significant. Retailers that would choose to operate extended hours would be required to obtain the appropriate permit from the Texas Alcoholic Beverage Commission, which is not expected to have a significant impact on the state.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
