LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

May 2, 2003

TO:
Honorable Robert Duncan, Chair, Senate Committee on Jurisprudence

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB2592 by Lewis (Relating to the compensation of certain judges who preside over certain proceedings.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code, Chapters 24, 25, and 32 to authorize district court judges and statutory county court judges to preside over drug court proceedings established by counties under Chapter 469 of the Health and Safety Code. The bill would allow such judges to receive supplemental compensation for the additional duties, provided funds are available and designated for that purpose.  The bill would take immediate effect if the bill receives the vote of two-thirds of the members of each house. Otherwise, the bill would take effect September 1, 2003.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.  The six counties in which drug courts currently operate (Dallas, El Paso, Jefferson, Montgomery, Tarrant, and Travis) would only incur costs to supplement the salaries of drug court judges if funds are available and designated for that purpose.
