No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure, Article 1 relating to appointment of counsel for indigent defendants. The bill would provide for counsel to be appointed after adversarial judicial proceedings are initiated against indigent defendants who have been released on bail and have not received a prior appointment. The bill would take immediate effect if the bill receives the vote of two-thirds the members of each house. Otherwise, the bill would take effect on September 1, 2003.
