No fiscal implication to the State is anticipated.

The bill would amend the Election Code to clarify that, while a city charter may prescribe requirements relating to a candidate's application for a place on the ballot for an office of a home-rule city, Section 143.005 does not authorize a city charter requirement that addresses timely filing. If a charter requirement exists that relates to an applicant's timely filing, Section 143.007 and other applicable filing provisions of the Election Code would supercede the charter requirements.

The bill would take effect immediately if it receives a two-thirds vote in each house; otherwise, it would take effect September 1, 2003.
