No fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure, Article 55 relating to the destruction of records following certain expunctions.  The bill would provide for the destruction of certain expunction records within 60 days after an order is entered or on or before the first anniversary date of the expunction order. The bill would require a clerk to notify the state's attorney of certain expunction orders for records destruction, and would provide a means for the state to object. The bill would have immediate effect if the bill receives the vote of two-thirds the members of each house.  Otherwise, the bill would take effect September 1, 2003.

Local Government Impact

No fiscal implication to units of local government is anticipated.
