No fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure to change the time frames in which a person arrested without a warrant for a misdemeanor offense must be released on bond if that person, following arrest, is first taken to a hospital, clinic, or other medical facility. The usual time periods would apply starting from the time the person is taken before the magistrate following release from the hospital, clinic, or other medical facility. The bill would take effect immediately if it receives a two-thirds vote in each house; otherwise, it would take effect September 1, 2003 and would apply only to an arrest made on or after the effective date regardless of when the offense was committed.
