No significant fiscal implication to the State is anticipated.
The bill would add to Chapter 125 of the Civil Practice and Remedies Code definitions for common and public nuisance. The bill would also make minor changes in the process for filing a suit to enjoin and abate a common nuisance. The Secretary of State indicates that any additional caseload could be absorbed within existing resources. The bill would take effect September 1, 2003 and apply only to a cause of action that accrues on or after that date.
