LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

April 29, 2003

TO:
Honorable Jaime Capelo, Chair, House Committee on Public Health

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB2833 by Zedler (Relating to a physician's report of a complication resulting from an abortion; providing a penalty.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would add Subchapter C to Chapter 170, Health and Safety Code and would require a physician to report a complication from an abortion or attempted abortion to the Texas Department of Health (TDH).  TDH would be required to develop a form that must include the patient's age, the number of pregnancies the patient had before the abortion, the number of live births, the number of pregnancies that were aborted, the number and type of abortion, the name and address of the facility performing the abortion, and other related information. The bill would make a violation under this subchapter an offense punishable as Class A misdemeanor.

The bill would be effective on September 1, 2003.

TDH indicates that the agency could implement the provisions of the bill within existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
