No significant fiscal implication to the State is anticipated.
The bill would prohibit the Department of Protective and Regulatory Services (PRS) to inspect a licensed day care center, licensed group day-care home, or registered family home for compliance with PRS fire safety or sanitation standards if the facility is in compliance with the fire safety or sanitation standards of a political subdivision of the state. PRS could determine whether the facility took corrective action or complied with any restrictions and conditions imposed by the political subdivision, and inspect the facility if there is no documentation or evidence of corrective action and compliance. The bill would require PRS to report observable violations of fire safety and sanitation standards to the appropriate political subdivision and to adopt rules necessary to implement the bill. The department does not anticipate any significant fiscal impact from the rulemaking requirement or the development of policies and procedures to implement the provisions of the bill.
