LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

April 8, 2003

TO:
Honorable Robert Puente, Chair, House Committee on Natural Resources

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB2888 by Cook, Robby (Relating to removing exemptions for certain wells and impounded water.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

Current law allows a person to retain 200 acre/feet of water on his or her property without a permit or more that 200 acre/feet as long as the average does not exceed 200 acre/feet in any 12-month period. The bill would make damming water or using a well to provide water for a lake or pond solely for aesthetic landscape purposes ineligible for the permitting exemption.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
