No significant fiscal implication to the State is anticipated.


The bill would prohibit the Texas Commission on Environmental Quality (TCEQ) from issuing a permit for a commercial nonhazardous industrial solid waste disposal facility if the proposed site would require for its construction a Corps of Engineers Clean Water Act 404 permit; or would be located over any part of a geologic formation that under natural conditions is saturated with water so that any part of the facility would be 25 feet or less above the uppermost water-bearing feature of the formation. Administrative costs to the TCEQ are not expected to be significant. Since the state generally does not operate commercial nonhazardous industrial waste sites, no additional significant impacts to state agencies are expected.
