LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

April 22, 2003

TO:
Honorable Jaime Capelo, Chair, House Committee on Public Health

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB3009 by Capelo (Relating to certain advance directives for medical treatment and medical treatment decisions.), As Introduced

No significant fiscal implication to the State is anticipated.

This bill would amend and add new sections to Chapter 166 of the Health and Safety Code relating to advanced directives for medical treatment.  The bill would establish procedures to follow in the event that a physician disagrees with patient-established advanced directives.  The bill would allow non-emergency medical services health care professionals to honor a physician’s do not resuscitate order in an out-of-hospital setting.

No significant fiscal impact is anticipated to the state because the Texas Department of Health indicates it could revise existing rules to implement the provisions of this bill with existing staff resources.

This bill would take effect upon passage or September 1, 2003.

Local Government Impact

No fiscal implication to units of local government is anticipated.
