FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

May 22, 2003

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB3113 by Dunnam (Relating to the definition of abuse of a child.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend Sec. 261.001(1)(E) of the Family Code to remove references to specific crimes. In current law, the definition of child abuse includes sexual conduct harmful to a child's mental, emotional, or physical welfare, and specifically cites the offenses of indecency with a child, sexual assault, and aggravated sexual assault. The Department of Protective and Regulatory Services indicates no significant fiscal impact.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
