No significant fiscal implication to the State is anticipated.

The bill adds the Municipal Solid Waste Management and Resource Recovery Advisory Council as an entity that the Texas Commission on Environmental Quality (TCEQ) shall work with to develop the market for recycled materials.

The bill would prohibit the TCEQ from requiring an occupational license for a person whose primary responsibility at a solid waste facility is to transport solid waste and who does not supervise any activity at a solid waste facility.

The bill would require the TCEQ to mail notice of administratively complete solid waste permit applications to the area's regional planning commission. In addition, the bill would prohibit the TCEQ from issuing certain permits landfills if the proposed facility is determined by the applicable regional planning commission to be incompatible with their regional solid waste management plan.

Any additional responsibilities to the TCEQ would be minimal and are expected to be absorbed within existing resources.
