The bill relates to the liability of the state for a violation of the federal American with Disabilities Act ("ADA"). The bill provides that a suit under this subsection may only be filed in a state district court not a federal court. The bill further imposes money damages on the state limited to the maximum amount of $250,000 for each person and $500,000 for each single occurrence for a violation of the ADA. The Office of Attorney General indicates that any legal work resulting from the passage of this bill could be reasonably absorbed with current resources.
The bill takes effect September 1, 2003, and only applies to a cause of action that accrues on or after the effective date of the bill.
