LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

April 15, 2003

TO:
Honorable Jaime Capelo, Chair, House Committee on Public Health

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB3193 by Uresti (Relating to the delegation of certain acts by dentists.), As Introduced

No fiscal implication to the State is anticipated.

This bill would amend Chapter 258 of the Occupations Code relating to practices by dentists. The bill would expand the provision that describes the type of dentist that can delegate to a dental assistant the application of a pit and fissure sealant.  This bill would allow a dentist that practices in an underserved area determined by the Texas Department of Health to delegate the procedure to a dental assistant. Current law allows only a dentist who is a Medicaid provider to delegate this procedure to a dental assistant. Based on analysis by the department, no fiscal implication is anticipated.

This bill would take effect upon passage or September 1, 2003

Local Government Impact

No fiscal implication to units of local government is anticipated.
