LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

April 18, 2003

TO:
Honorable Norma Chavez, Chair, House Committee on Border and International Affairs

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB3377 by Rangel (Relating to the filing of a notice of seizure and intended forfeiture in an asset forfeiture case.), Committee Report 1st House, Substituted

No fiscal implication to the State is anticipated.

The bill would authorize a notice of seizure and intended forfeiture of property seized at a federal checkpoint to be filed and the proceeding held in the county in which the seizure occurred or, with consent from certain parties, in a county adjacent to the county in which the seizure occurred. The bill would take effect September 1, 2003.

Local Government Impact

In counties where a federal checkpoint exists and in adjacent counties, the courts could see an increase in caseload. The fiscal impact would vary depending on the number of proceedings, as well as the length and complexity of each.
