The bill would authorize the abolition and procedures for abolition of certain water control and improvement districts as long as particular criteria are met. The bill would take effect September 1, 2003.
If the governing body of a municipality adopts an ordinance to abolish a water control and improvement district and is petitioned within a certain period of time by 10 percent of qualified voters not to abolish the district, and if the governing body does not vote to repeal the ordinance, the governing body would be required to hold an election regarding the issue. If the district is abolished, the municipality would assume the district's property and assets, and become responsible for providing the services the district had provided. Because of the criteria that must be met before a district may be abolished, and because property and assets from the district would be transferred to the municipality, the fiscal impact on the municipality would be insignificant.
