The bill would amend the Transportation Code to require the Texas Department of Transportation (TxDOT) to develop a statewide transportation plan to expand and improve transportation facilities and transportation operations in the state. The bill would establish requirements for the transportation plan including provision for appropriate financing methods, such as bonds and other forms of borrowing. The bill would require TxDOT and other entities to cooperate to implement the plan. The bill would expand the definition of a highway and would provide that a Transportation Commission order creating a regional mobility authority may include methods by which an authority may raise revenue and acquire property in addition to other appropriate powers and duties of the authority. The bill would also require a public transportation provider to consider the advice and recommendations of the public transportation advisory committee. The bill would allow the Texas Transportation Commission to authorize TxDOT to construct rail facilities.
The bill would require that a fee collected in connection with the issuance, renewal, or reinstatement of a driver’s license, commercial driver’s license, or personal identification certificate may be used only for a purpose for which revenues are dedicated under Section 7-a, Article VIII, Texas Constitution.
Amounts reflected above are based on data provided in the Comptroller’s Biennial Revenue Estimate. Currently, fees collected in connection with the issuance, renewal, or reinstatement of a driver's license, commercial driver's license, or personal identification certificate are deposited into the General Revenue Fund as undedicated revenue.
Based on the analysis of the Comptroller of Public Accounts, it is assumed that the interpretation of "a purpose for which revenues are dedicated under Section 7-a, Article VIII, Texas Constitution" in the bill means that 75 percent of the affected fees would be deposited to the State Highway Fund, and the other 25 percent would be deposited to the Available School Fund.
