No fiscal implication to the State is anticipated.

The bill would amend Section 158.037, Local Government Code, to allow a sheriff whose personnel are subject to civil service protection to appeal in district court decisions made by the civil service commission that favored a sheriff's office employee. The bill would take effect September 1, 2003.

Local Government Impact

Although the county sheriff's office would incur costs of litigation if the sheriff files an appeal, the frequency of such occurences is expected to be low. Additionally, litigation costs could be offest by the overturning of a decision that, if allowed to stand, could have a significant negative fiscal impact on the sheriff's office.

No significant fiscal implication to units of local government is anticipated.
