LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

February 19, 2003

TO:
Honorable Leticia Van de Putte, Chair, Senate Committee on Veteran Affairs & Military Installations

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
SB173 by Nelson (Relating to deferred payment of property taxes for certain persons serving in the United States armed forces during a war or national emergency.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Section 31.02 of the Tax Code, relating to a 60-day waiver of penalties and interest on delinquent property taxes.  It replaces references to specific dates and to the Persian Gulf hostilities with language that would extend eligibility for the waiver to military personnel on active military duty because of a "war or national emergency declared in accordance with federal law."

Local Government Impact

Local taxing units would likely experience some loss of revenue because of the temporary waiver of penalties and interest. In addition, those units would likely experience a temporary reduction in revenue flow from persons who used this waiver.

No significant fiscal implication to units of local government is anticipated.
