No significant fiscal implication to the State is anticipated.


The bill would amend Section 32.024(p) of the Human Resources Code regarding the provision of respiratory therapy services in the Medicaid program by replacing the text "for ventilator dependent persons" with the text "to a recipient of medical assistance under this chapter."

The Health and Human Services Commission (HHSC) interprets the bill as not increasing the number of Medicaid clients who would be eligible for the provision of respiratory therapy services, and therefore estimates that the bill would have no significant fiscal impact.

However, if the effect of the bill were to expand the provision of respiratory therapy services to Medicaid clients who are not ventilator dependent persons, HHSC estimates that implementation of the bill would cost approximately $215,000,000 in All Funds (including $85,000,000 million in General Revenue) in fiscal year 2004, with increasing costs in subsequent fiscal years.
